Question of the Week

How to inform the Department about changes to your partnership status without jeopardizing the visa application process?

Category: Visa for Australia

Question asked

I am a sc 457 temporary visa holder and with a sc 190 visa application that is currently being processed (invitation received Dec 2019, applied Jan 2020). My ex-partner who is non-Australian has been on my 457 visa and the secondary applicant to the 190 visa. During a travel abroad in Feb-March 2020, Covid happened, and I could not return to Australia from 20 March 2020 until 15 Dec 2021. My then-partner had not accompanied on my travel. Our relationship has recently broken down. As a reaction to this, I have added a note on the 190 application some 3 weeks ago that the relationship between the me (primary applicant) and my ex-partner had ceased. I have repeatedly contacted my migration agent if I had to do anything else but have not received an answer from them.

I recently realized that I probably also have to inform DIBP regarding my 457 visa about the relationship. I don't want to jeopardize my 457 visa or my 190 application. Also, in the unlikely case that I can patch things up with my ex-partner, I don't want to make things worse for her. She has already left Australia anyway. What do I have to do regarding the 457 visa and can I do damage control regarding the 3 weeks?

Dear S

You need to inform the department that your relationship has broken down, and your partner is no more your dependent. I am not sure for how long the sc 457 visa still valid is, however, you are not liable for anything. You are only supposed to inform the department regarding change of the situation, and you are not in breach of any visa conditions. You can do this through immiaccount: Update details and mention the situation

You have also informed the department with your sc 190 visa application, just relax and nothing to worry about.
