Question of the Week

I have applied for my 2nd Working Holiday visa and may be in violation of the PIC 4020 requirement? What can I do now?

Category: Visa for Australia

Question asked

I had applied on October 2nd for a second working holiday visa. I had completed the 88 days doing work in a bushfire affected area. On my application I wrote June 29th as my start date and September 25th as the end date of when my days were complete.

However, I failed to take into account the few days I took off and how that put a few weeks of my work as single days worked rather than full time week with weekends counting. I continued volunteering on the farm past the date I provided and when I realized the error of my date, I tried to rectify it by filling out the change of information on my visa application.

Telling them I miscalculated, and my single days counted towards the visa and I should have put October 1sr as my end date. I worry that they will see this as providing false information, though it’s entirely a massive oversight on my part and not false at all.

With all the stress of the visa and with issues at home, I made the decision, quite quickly, to withdraw my application and return home for a while. My question is; if I submitted the request for withdrawal, will this void any Pic 4020 or bans from occurring if they think information was false?

Answer provided by Migration Agent

Dear T.,

If you have worked for 88 days and you can substantiate it, you just need to inform the department and mention that it was only a human error.

Fill in the Form 1023 and inform the department about the exact end date. You can also upload a separate sheet mentioning each working day along with working hours on the immi portal.

If you have decided to withdraw the application, you will not be banned due to the breach of PIC 4020.

Feel free to contact me if you need any assistance.

What is Public Interest Criterion (PIC) 4020?
PIC 4020 is a requirement for the grant of most visas. Under PIC 4020, a visa might be refused if bogus documents or information that is false or misleading is given to the Department or the AAT (www. aat. gov. au)
